HSMP - General Tier 1 - calculating previous earnings

Post by myfuente » Thu Mar 25, 2010 8:51 am

Hi All - I need help in determining whether I can claim the previous earnings points. I am under the HSMP (Post-study work visa) at the moment and will be applying to the HSMP (General visa) in September.

Over the past year I have been making a gross salary of £18500 from Jan. 2009 to Feb. 2010. I have just received a raise to £20000 in Feb 2010. When I input this information into the points calculator I have enough points but when I put in the band of earnings as what most of the year was (£18,500) I don't have enough points. Sorry if that's confusing. Please help

What should I go with?!!!

Many thanks,

Melissa Fuentes

You can't claim previous earnings points for anything under £20,000 at the moment
Moreover, from 6th April 2010 rules are going to change for initial Tier 1 applications and minimum earnings would be raised from £20,000 to £25,000 and that too will only give 5 points

Your best bet is to calculate your earnings till now and if you can claim 75 points then post your application before Good Friday 2 April 2010 (unless off course if you think you can claim 75 points when you are planned to apply in September)

please read the changes here

Highly Skilled Migrant Programme (Tier 1)

Post by myfuente » Tue May 04, 2010 4:40 pm

I am a bit confused still on the recent changes and how it will affect me. I receive the points for age = 27, education = masters degree, UK experience = Yes, Language = English. I am moving from a Post Study work visa into the Highly Skilled Migrant Programme. Does that make a difference in points? Also am I affected by the change to £25,000? If I haven't made £25,000 at all - which I have only made £20,000 since March 1st, does that dis-qualify me?
Sorry just trying to wrap my head around the changes and how they affect me because I am getting conflicting information.

Thanks,

Melissa Fuentes

Unfortunately PSW visa holders are having tough time meeting ends meet. Above mentioned rule is true.

i know 2 people who got rejected (they were on PSW visa) while applying for Tier 1 becuase they tried to show over-time /business and never provided complete details ...Also UKBA enqired to part-time employer,etc.... bottom-line please don't do anything stupid that will ban you for 10 years!

To PKumar -

No I am not going to do anything dis-honest I am just trying to figure out whether my visa application for the Tier 1 would be successful or not.

I am inquiring whether it makes any difference that I am switching from a PSW visa to the Tier 1 in terms of minimum salary over the last 12 months. If the minimum salary is set at £25,000 even if I am switching from a PSW to Tier 1 then I am assuming my application will be unsuccessful but if the minimum salary, in my case, is £20,000 then I will be successful.

Please help with this question. That is where I am confused.

Thanks,

Thanks,
It wont make a difference to minimum salary that you have been on the PSW visa. It is not based on what your current salary is (after your pay rise in February), it is what you have earned in the last year up to when you submit your application. So the fact that you are on £20,000 now doesnt change the fact that you only earned £18,500 in the last 12 months. You must add up your last 12 months of payslips immediately prior to submitting your application (I think you can use any 12 months from the previous 15 months) and this must come to £20,000.

When I extended my Tier 1 general VISA last year I only just scraped into the salary requirements by £15. I waited an extra month before submitting as any earlier and I would not have earned the required amount.
