Completing 5 years in July 2011

Post by ukresident11 » Sun May 09, 2010 10:53 am

Hi,

I will be completing 5 years in the UK by the end of July 2011.
I got my visa stamped by 15 July 2006 and I arrived in UK on 29 July 2006.
Can I apply for Permanent reidency by the current rules or will I fall under the new rules that will be applicable in July 2011?
thanks for your help.

if you follow this link: http://www.ukba.homeoffice.gov.uk/sitec ... nts-earned

the article says that "We will announce the specific date of introduction closer to the time."

so, it's just a waiting game!

Indefinite leave to remain

Post by ukresident11 » Sun May 09, 2010 12:30 pm

Thank you.
Will keep looking into that column.
How would this affect the dependents? Will the rules for the main applicant be same for dependents... say, the main applicant cannot be outisde the country for more than x days during the tenure of 5 years for permanent residency..will this be same for the depedents?
thanks

(According to current rules) Regarding absences, as far as ILR is concerned there is no limit on absences from UK for the dependents. But dependents are, just as main migrants, subject to residential requirements at the time of naturalisation.

Regarding new laws coming into affect, it seems that everyone other than those protected by HSMP JR will be affected by the new laws, dependents included.
