Tier 2 Prospective Salary

Tier 2 Prospective Salary

Hi, Im going to apply for Tier 2 (General). Im on PSW visa and my company is providing me COS. Im having some doubts on prospective salary section.

Im earning 20.5K + 25% performance pay. Im applying under COS code 3132 as Senior PC support. It says minimum salary rate £24900.

As per in HO Tier 2 guidance (http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf)
*** Section 67 says "If your salary does not meet the appropriate rate set out in the codes of practice, your application will be refused, even if you score enough points for your prospective earnings."

*** Section 75 says "The job must still be paid at or above the appropriate rate, even if you are not claiming points for prospective earnings."


I have got 2 questions:
1. Even though I'm applying via PSW to Tier 2 (General) route, Do I have to show that my salary is higher than the minimum rate for the appropriate Job title?

2. I think performance pay doesn't count as per HO guide, if so - If my company say that my prospective earnings would be £25K, will it be sufficient for my Tier 2 application please?

*** Section 73 says "You should ask your sponsor to confirm the salary details on the Certificate of Sponsorship. You do not need to send any other evidence of your prospective earnings."


Can any one kindly guide me on this please?

its not 100% clear in my head but im told that even for psw to tier 2 route, one has to satisfy job title and salary requirement.

in COS, your employer has to write about prospective earning. make sure the figure they quote is more than it states on guidance notes(HO). HO needs a salary figure and not interested in percentage/bouses etc etc.

when you come to extend tier 2 gen visa, you will need to show that you were paid accordingly so make sure that your salary is paid into single account as it will simplify the cross-checking from caseworker's point of view.
