Settlement visa advice for my husband updated more info need

Post by skyepark » Mon May 10, 2010 6:02 am

Ok so, I met my husband in the uk while he was an overstayer, he left to go back to Russia. I am now in India and he will be joining me on a 6months visa. I will be going back to the uk next year and hope to get him a visa for him to join me at the same time rather then him going back to Russia for another period of separation.

what can he apply for? next year we will have been married for over one year. When should we say we met since he was an overstayer when we met. Its all so confusing.

Are you a British citizen? What is the six month visa he'll be on?

In that case he'll need to return to Belarus and apply for Spouse visa.

You have to be honest, the app form asks and you tell. They will check, maybe not now, lie, say visa goodbye.....

Overstaying in itself is not a reason for refusal. did he ever use deception or fraud to gain entry to UK - ie false passports?

But tell the truth because the UKBA doesn't like deception of any sort and will refuse.

Ok so we are both in india at the moment and will stay for one year. We wish to arrive in the uk together is it advisable to apply for settlement visa in the uk? I am doing an inernship and will get a job afterwards in india. I have savings and hav support from someone who will let us stay temporarily stay at theirs while we look for a rented place and work. Feasible? We will mention his overstay and by the time we will apply we understand that his one year ban will be up to be refused. While overstaying he also worked illegally do we have to mention this he had no public funds either. does the emphasis on the application then have to be about his overstay and his apology and reasons fo it? Many thanks
