Tier 2 Partner Question

Hello all,

I am currently in the UK as a Tier 2 (General) migrant, and my partner is on Tier 2 Partner Visa. Our visa's were granted Aug 2009, and are valid until Aug 2012.

I am currently looking at changing employer, and believe I have everything I need to apply. My question is, does my partner need to re-apply also? As I will still be on the same Visa, just under a different certificate of sponsorship, and her leave does not expire until Aug 2012.

I have search the forums and UKBA website and cannot find anything related to this situation.

Thanks for the quick answer, I suspected that would be the case.

Out of curiosity, where is this stated? Or is this from experience?

When your (current) Tier 2 migrant leave to enter/remain becomes void (because of a new leave, based on a new sponsorship), the dependent's leave is also invalidated (one cannot be a dependent on a non-existing migrant).

Again, thanks for your answer. I can understand your reasoning, however I can't find anything that states this, and don't understand why this would be the case since her visa clearly states "Tier 2 Partner" whereas mine includes CoS number etc. She would still be a "Tier 2 Partner".

Don't get me wrong as I'm not trying to start an argument, and it is not a problem for us to both reapply. Just extra hassle involved collating info/documents etc. as we are unmarried. Acutally, while on this subject - I understand that I would not need to provide evidence of maintenance for my application, however it is not clear from their Guidance notes if I need to provide it again as part of my partners application. The only problem being obtaining bank statements from HSBC.

In any case, I am contacting the UKBA for their guidance on these matters.
