Able to visit after visa refusal?

Post by Lolly1 » Sat May 15, 2010 2:45 pm

Sorry if this has been asked before but i was hoping someone can help.
I was born in the UK and lived here all my life, my fiancee is American and has just been refused a fiancee visa mainly because of stupid mistakes we made. We will appeal and have been told we can send additional documents in the hope it will be resolved and will not need to go to a appeal hearing.
Some of the documents we included the first time where not orignals so we plan to submit the orignal copies this time, however on the appeal notice it says to send the appeal form but DO NOT include orignal documents, so we are really not sure what to do....
Also is it still possible for him to visit me in the UK while the appeal is going through, we have not been able to see each other for 7 months now and the thought of more months apart in killing us : ((

He'll have to apply formally at his nearest UK embassy and mention the refusal (it's on the forms I think) but to be fair it's unlikely to be granted, the assumptions made by the authorities are unfortunately the worst...

If it is just a matter of you not sending the original docs, you can do one of two things.

1. Reapply and make fresh application ensuring you give the correct docs this time. You will have to pay the fee gain though.

2. Complete the Appeal Notice and send an explanatory letter with it saying you made a genuine mistake with not enclosing orgiginal docs, and you attached teh original document with teh appeal notice. Ask them to review it in view of teh correct docs now being enclosed. This could drag on for a fe w wekks though.

Unfortunately he will not be able to visit you untill he gets the visa from of the above two options
