I am currently in need of urgent help....I applied for a one year student visa around one and half months ago on 31st March...I got a visa refusal letter from the HO last Friday....I was refused visa on the ground that I did not maintain my balance for 28 days...Even though according to me I definitely think I maintained the balance for 29 days....I was on Post Study Work Visa prior to this application....hence I had to show a maintenance of £7200 plus any outstanding course fee and that was £1500....so in total I had to show £8700....
According to the Home Office Tier 4 Policy Guidance:
Documents needed to show money available to the student
127. A Tier 4 (General) student must show that he/she has held the required money for a consecutive 28 day period (finishing on the date of the closing balance) ending no more than 1 month before his/her application.
128. Where a student is providing evidence of maintenance from a single account, we will always assess the funds available to the student from the closing balance given on the document provided as evidence.
129. Where two or more pieces of evidence from a single account are used (for example two bank consecutive bank statements) we will assess the funds available to the student from the closing balance of the most recent document.
I submitted a total of of 2 bank statements from the same account:
The first statement is dated from 7 Dec 2009 to 5 March 2010
I submitted an amount of £8700 on 26th February. The closing balance is £8700.
The second statement is dated from 5th March 2010 to 26 March 2010
The closing balance is £8700.
I submitted the required £8700 in my bank account on 26th Feb....and the last date of the statement is 26th March....so the total number of days comes to 29 days....
I made the application on 30th March. Though the Home Office has dated my application 1st April.
Is the maintenance fund + outstanding course fees I showed in accordance with the Policy Guidance stated above?
There were a couple of more mistakes in the visa refusal letter....Firstly the visa refusal letter states that for the last couple of years I have been extending my visa as a student, even though I was on IGS (International Graduate Scheme) + PSW (Post Study Work) visa for the past couple of years.....Secondly according to the Home Office as I was on "student visa (even though I was on PSW visa)" prior to my current application, the visa refusal letter states that I have to show a maintenance fee of £1600.......
