Late arrival to UK

Hi All,

My HSMP was granted on 20th Jan 2007 and I came to UK on 15th March 2007. I already got my extension but my worry is ILR as my stay will expire on 19th Jan 2012 while as per ILR rule I must stay is UK for 4 years and 11 months but I will be one month short for this criteria.

Can some one please let me know whether I will be getting another extension or Is there any provision Temporary leave to remian for 1-2 months so that I can qualify for ILR. Or is there any other quich fix for this?

I am meeting all other criteria except this one.

Any advise / help will be appreciate.

You'll not be "getting" another extension. Instead you'll have to apply for one!

No workaround / quick fix!

Anyhow, the response above answers your query.

Also, if your HSMP application was submitted on/after 05-Dec-06 then the earned citizenship laws will affect you. So in all likelihood, you'll be applying for probationary citizenship as and when you become eligible .. and not ILR.

Mehta - Just curious to know more about the earned citizenship. Do you mean to say that first I will have to apply for another extension so that I can qualify for 5 year period then I will get probationary period for 1 year then I will qualify for ILR and then UK passport.
Do you have any idea how long do I need to wait to get UK passport so that I can plan accordingly because if it going to take very long time then i will think of going back.

Assuming that you become eligible for probationary citizenship after spending 5 years in the UK (or more if earned citizenship laws require so), you'll need to apply for a Tier 1 extension in Jan 2012 because your current leave expires before your 5th anniversary of entry in the UK.

Then, as and when you become eligible for probationary citizenship, you'll need to apply for the same.

UKBA / Labour government had announced implementation of earned citizenship from July 2011. But the info. has been removed from UKBA site since the new coalition govt. assumed power. Therefore, there is a degree of uncertainity as to whether earned citizenship will be introduced as announced earlier or whether the current govt. will make some changes to the date of implementation .. or if it will be introduced or not. Like everyone else, you'll need to wait for more detailed information to become available.

To be honest, I don't disagree with Wanderer, one of most helpful persons around. Seeing your posts, IMHO, people will tend to form such an opinion - impatient, arrogant and, perhaps, one who looks down on others.

Remember, like most others you'll visit this site only when you have a problem. But a few of us on this forum spend (personal) time in an effort to solve those issues. And, to expect the seeker to be polite is not out of line. As you said - it's give and take. But look who crossed the line first - Me? Wanderer? Or you?

This said, let's move on. I hope you have some answers now. Feel free to post your queries - but in a civil manner and only in English!
