Spouse Visa questions

Hi,

I am a EU Citizen living and working in UK. Soon I'll be getting married to a US Citizen either in the USA or in Germany.

I'd have a couple of questions:

1) what's the time it normally takes to receive the 2 year spouse visa since we submit the application?

2) In order for the spouse to receive and keep the visa, does she have to live permanently and constantly in UK with me? I am asking this because the plan is that she would permanently move in with me as soon she finds a job in UK and in the meantime she would be traveling back and forth between USA and UK. Do you think this would be fine again just to get the spouse visa for 2 years?

yes, I am a German citizen. I have been living and working in UK since January 2010.

There is no specific maximum absence period under a spouse visa. But in my personal opinion, it wont look good if the absences are very frequent and long, when the time comes to apply for ILR. You are an eu citizen and you automatically acquired PR on Jan 2010 hence your are now "a person present and settle in UK" and you wife qualifies under UK immigration rules.
But the eu route is still open to, if you choose to.

Have you got a PR stamp on your german passport yet?
