Tier 1 General

Tier 1 General

Hi

I just need an advice. my brother applied for tier 1 general switching from psw, home office has retained his application on the basis that they have to make checks on his previous immigration history of student status. one of his previous college has been closed but he did not submitted any documents for applying under tier 1 general. Will his application be approved or refused due to his previous immigration history?

his curent leave to remain is also expired, so what is his current legal status? is he a overstayer as on last day of his visa expiry he applied and being refused with no appeal right as he was having leave on that day and being adviced to re-apply out of time which he did within 12 days after refusal.

will be really obliged

The college that the PSW was for? Or one before that? If it is Cambridge College of Learning his chances do not look good.

This a bit confusing, what was the previous refusal about?

If UKBA had advised him to re-apply (even out-of-time) then the application will be processed as usual .. even if it is an out-of-time application. But if your cousin has plans to apply or settlement under the 10 year long residence route, I am afraid his ILR clock has been reset.

This said, if he received his PSW visa on basis of qualification that was (or is now deemed) bogus or if he breached immigration rules at any time (e.g. - worked for more than 20 hrs on student visa), then his application is likely to be refused.

His previous refusal was on last day of his psw visa expiry (Tier one) due to invalid application as one specified document was missing . so on refusal letter we being adviced to re-apply, now application is accepted but Home office making further enquiries about his previous student visas, what is his legal status (wok and live) as his application is out of time and if his attendence was according to requirement while he was on study visa what are chances of approval
