refused visitor visa

Post by yaelhitch » Mon May 31, 2010 4:24 pm

i applied for my boyfriend from gambia to have a 6 month visit visa but was refused both times as they didn't think he would return.

my thought now is to try for a fiance or marriage visa however in the previous applications i didn't say he was my boyfriend so will the new visa application look false?

any suggestions would be great

thanks

on behalf of my friend again!

what are the other options for him to come to the UK as the only reason he was refused as they didn't think he would return. so i don't understand how you can modify this. Gambia is a developing country and although he has a job its not one where you can get references or pay slips as he just lives day to day sellling products. the vist visa was only for 6 months and then he would return how can we prove this?

Well first of all for a single man its tuff to prove this on the face of it.
The applicant has to establish that they have some strong ties back home. A house, family, good emplyment history, a well paid job is the best way to prove it. There is no magic formula to prove the intention to return home after getting a visit visa. He already had 2 refusals, so next time he makes an application, first thing ECO will see is a person desperate to get into UK and making repeated attempts to do so.

yes i can see what you mean. but each time he applies costs around £400 so that must show he has some money and he is not applying for a student visa or a family visa just to come and stay with his friend for 6 months.

its so frustrating but i think my friend said she will try one more time as they cannot afford to do it any more and i told her to go to a lawyer for some legal advice. thanks guys will keep you updated

By applying for a fiance(e) / marriage visa, he /she would just be proving UKBA right! Outright refusal, IMHO.

They would also mention deception in previous applications, if he makes a fiance visa application.

i can see how that would look. so is the only option to try again for a vistors visa or is there any other visa he can apply for?

Why not keep/stay in contact with your boyfriend for a while (say about 6 months) and if your relationship is real and going forward, you can go down to Gambia, marry your boyfriend and if you meet the rules apply for a spouse visa.

Fiance/marriage visa might be difficult at the moment based on his previous applications bcos they suggest him to be "desperate" to get to the UK like you have been advised already. If you marry him then the onus is on you to prove you meet the rules as a "sponsor" not him proving enough ties to return to his home country.

Best of luck

Unfortunately so many people 'shoot themselves in the foot' when they fail to mention a relationship in a visa application...and then need to do so further down the line. It's seen as giving false information...either in the original application or subsequent ones. 8)

on behalf of my friend again!

my friend has been to Gambia 3 times over the last year and spending at least 2 weeks there every time. i think the best thing will be to carry on visiting him in gambiam get more eveidence together of a realtionship and then try again in about 6 months.
