WP to Tier 2 - English language requirements

Post by tara55 » Mon May 17, 2010 7:00 pm

Im in UK on 5 year WP issued in 2006. My company is reviewing my salary and it seems there will be around 10% to 20% increase in my salary. I will be working on same job though; no change in my role and responsibilities.

After reading various posts, It seems a substantial change in salary will mean a new application under Tier 2.

My company is happy to go ahead with Tier 2 process. However, I have just checked in UKBA Point Based calculator, my degree does not meet English Language requirements. Im not sure why as my degree was actually taught in English.

As Im already in UK on highly skilled work permit and it has been around 4 years Im doing this job. Will I still need to meet English language requirements ?

Yes, if there's a requirement for a new CoS and a new Tier 2 application.

But do you need a new CoS / change in employment application?
Changing your job wrote:You will not need to make a 'change of employment' application if you want to stay with your current employer but your job will change in other ways (for example, if you want to change to a new job in the same SOC code, or if your pay will increase).

Sushdmehta, thanks for linking a UKBA reference, Im not sure same rule will apply to me as Im on old WP scheme not Tier 2.

Do you think my company should fill a technical change of employment for salary increase?

However, if I read technical changes of employment guides, it clearly says any substantial increase in salary will mean a new tier 2 PBS application.
