My husband currently has a two year settlement visa that we took when we married (he is albanian nationality). This is due to expire in January and I understand the next step is indefinate leave to remain. we live and work in greece, i am based in greece for my job and my husband works here too which means out of the 16 months he has had this visa he has actually only spent around 6 months in the UK so i don't feel he will be eligable to apply for indefinate leave to remain and we do not wish to "settle" in the UK as such. The reason we took the settlement visa was becuase that is the catogory we fall into and when we do go to the UK for a few months in the winter, my husband works part time in the family business, as he is allowed do so with this type of visa. Is it a possibility to extend his current settlement visa, or is indefinate leave to remain the only next option for us. It costs a lot of money to apply for ILR and my husband will probably not pass the life in the UK test as he has not spent much time there. I hope there is an alternative. I believe we should not be discriminated againt because we do not spend a lot of time in the UK, because although I am based abroad, i work for a UK company, I pay my tax and national insurance and i am still a UK resident. I hope someone is able to help. I have heard something about the EEA treaty, might we fall under that catogory as my husband has lived in greece since being a child and has lived here legally with all the correct green cards and papers, he also has a greek residence card as a family member of a european union. any advice would be greatly appreciated.
