Please help!! Really need help.

My situation:

Lived in UK since 1997-2010.

Here is the breakdown:

Secondary school: 1997-2004
University for first degree (BA): 2004-2008
Postgraduate University : 2008-present

The problem:

I have been having my education in the UK, but the problem arised when I did my postgraduate course but failed. I have been given a choice by the University to redo the project and they did provide me with a CAS number as well. My mother doesn't want me to go back to the UK but I do, so I have to raise the money to go back. I should be able to raise it within a few weeks so I can re-extend my visa.

I believe for re-extension under Tier 4, I need 1,600 of maintenance funds is this true?

The problem I have is, I am now back in my home country. On the assumption that I can come back to re-extend my visa, technically how long could UKBA stamp me for?

It's practically July now and the deadline for my resubmission is September and there is another deadline for November.

Just want to get an idea. I didn't know I could apply for ILR after 10 years, only learned this now that I am back here, so upset about that.

If my Tier 4 re-extension was successful and I went back in time for September, could I apply for the ILR as well or is the time between March - September disqualify me, despite the fact I was continuously in the UK from September 1997 - March 2010?

Cookie Dough, if you're still there, the answer is yes you are still eligible to apply for ILR under the 10-year Long Residence concession. There is no requirement to apply 'in-time' and any previous continuous 10-year legal stay will count, provided that you still have all the passports for that period and can explain all your absenses (under 18 months in total) during that period.

Please seek more information on the "Indefinite Leave to Remain" section of the forum.

If you want to remain in the UK, I suggest you act fast as there is currently long waiting times for this type of application, wide anticipation of the withdrawal of this concession in the July 2011 policy review, and the fact that with a Tory government in power, anything can happen.

Wanderer, Section 2.3.5 of the IDI and Example 4 made specific provisions for applications made up to 6 months out-of-time, which in the OP's case is up to September 2010. Therefore I suggest that the OP moves fast before it reaches 6 months and the case gets more complicated.
