Is there any one 2 help me....?

Post by nikip » Sat Mar 11, 2006 1:13 pm

I'm a Sri Lankan national, I'm in UK for last six months having two years of mutiple entry work permit. I like to sponsor my wife from Sri Lanka(SL). I've confusion and it's headache for me as well. This is the problem MY FIRST NAME IS SELVARAJAH AND MY SURNAME IS MURUGESU (IN MY SL PASSPORT ALSO SAME). IN MY WIFE'S PASSPORT HER FIRST NAME STATED AS SHAMINI AND HER SUR NAME STATED AS SELVARAJAH (WHICH IS MY NAME), WILL THERE BE A PROBLEM AS THIS NAME CONCERNED. OR IS THERE A NEED OF CHANGE IN MY WIFR'S PASSPORT SURNAME COLUMN AS MURUGESU (MY SURNAME).

Please help me on this.

Thanks in advance[/b]

As there is no compulsion under UK law for a woman to have the same surname as her husband ... it is merely a convention that most choose to follow .... you and your wife having different surnames is not an issue.

Clearly your marriage certificate will prove that the two of you are indeed married, which after all is what counts here.

So in short ... stop worrying about this.

But just one final point ... don't post messages in block capitals. On the internet that is equivalent to shouting. On this board messages in block capitals are liable to be deleted without notice.

Hi Nikip

Others will add to the list but in my opinion you need to provide

1) A company letter for your self and what you do, it would certainly help if the letter mentions about your wife.
2) Your pay slips and bank statements to demonstrate you are able to maintain your selves.
3) Your accomodation details (rental agreement, bills etc)
4) Your marriage certificate and may be a few pictures of marriage as well.

So in short you need to provide them job, financial and accomodation details.

Best of luck.

As well as the things listed by jazbaati99, don't forget about the application form! The VAF1 should be used. That can be downloaded by clicking here.

It might also be useful to look at Guidance - Work permit holders (INF 13), in particular the section headed "Can my dependants join me in the UK?".

If 3 months bank statements is all you have then just provide them. That should be OK in any case.

Consider why those statements are needed? To show that your wife will not need to claim certain Public Funds. As long as the statements show that to be the case then you should pass that test.

Hi, Thank you again. Greatly appreciated. Yes only i have three statements, bcos it took about three months to open an account here with a utility bill. Actually i'm recieving around 1700 pounds per month (after deduction of the tax) and in my last statement the balance in bank as per statement is (in second statement, and i'll recieve the 3rd during this week), around 2300 pnds. is that ok to carry on with my next statement, or do i have to show more balance for them.

Proceed with the application? Why not?

Two year rule? What two year rule are you talking about?

You got married last May. You have been in the UK for six months? You have been with your wife for about 8-9 months? Where is your wife? In the UK? Or she is in Sri Lanka, and you are temporarily separated by thousands of miles?

Please clarify?

She's in Sri Lanka, we r not separated, we r living together. I thought a husband can sponsor his wife after two years from wedding date. Is that so...? Thanks :?

If she is in Sri Lanka, where are you? Your opening post gave the impression you are in the UK?

I am not suggesting your marriage is failing .... but at this moment in time are the two of you thousands of miles apart?

Two year rule that you mention? It does not exist. Are you confusing this with a possible HSMP application where the spouse's qualifications can only be taken into account after two years together?

In short, if you are in the UK and she is in Sri Lanka, why have you not applied for a dependent visa for her?

But a final check .... your current visa in your passport .... when does that expire? About 18 months time? And your Work Permit? What sort of work are you doing?

Sorry for the confusion, as i said still i have 18 months of visa here in uk and now i've here in UK. My wife is in sri lanka, if i answer ur qustions, i came here last october and i've only 3 months of bank statements. also just we r miles far away that's it. there were no any other problems between us and i've waited for the bank statements, yesterday i've recieved it. as i said i've around 2500 pnds as balance. and i'm working here as a sys analyst. do i need to contact any solicitor for this or shall i proceed my self. If i cannot get a letter from my company is that affects my application. Pls advice me on this. Your help will be highly :x appreciated.
