Urgent help needed - Tourist visa for wife

Post by destiniation_london » Wed Jun 30, 2010 3:29 pm

Greetings Forumites,

Its a bit tricky & complicated situation, let me explain a bit of background -

I came in UK in September 2006 on a work permit.
In May 2009, I switched myself to Tier-1 General visa valid till 2012.

But due to some family issues, am planning to return back to India permanently in a couple of months time.

Last month I got married in India, and am planning to bring my wife over to stay with me. But as am planning to return back to India in 1-2 months time for good, instead of applying for dependent visa we applied Visitor visa (6 months) for her.

But, my wife got refusal letter yesterday stating -
Visa officer being uncertain if she would return back within 6 months given your spouse have visa valid until 2012.

We have been given full rights to appeal, but we are thinking of not to appeal but instead re-apply (as heard it takes atleast 6-8 weeks to hear appeals). We were thinking of re-applying and stating my intention of not contunuing in UK in the invitation letter.

Questions -

Am not sure what to state in the invitation letter, as its totally my decision to not continue living in UK after 2 months. Has anyone else been in the same situation.

I've consultated few immigration consultants and they told me to write a strong Invitation letter stating your intention to leave UK in 1-2 months time and that's the reason you did not apply for dependent visa.

Not sure if i've managed to explain it properly to you all. But in short, I wish to re-apply tourist visa for my wife to accompany me in uk for 1-2 months, after which we both would leave UK for good to return back to India. Please can somebody throw some ideas.

PS - as mentioned it totally personal decision to leave UK in 1-2 months time and it has no relation with my job. So, don't think I'd be able to get any sort of letter from my employer mentioning about it.

Strong invitation letter is a good idea i feel. You may need to state a very good reason why you are planning to get back to india..If you have resigned your job, enclose the relieving letter.
