Wife eligibility for British Citizenship ?

Post by gtilr88 » Fri Jul 09, 2010 9:52 am

Recently we got the ILR in June 2010.

My case is as follows:

I got the ILR based on 5 year stay on WP + Tier1.

My wife came to UK on WP dependent in May 2006.

She was away from this country for continuous 7 month during maternity in 2008 {May 08 to Dec 08} . During absence she was getting company maternity pay and she was paying NI and taxes.

She also got the ILR along with me in June 2010.

Can my wife will be eligible for British citizenship in June 2011 based on 5 years stay as she was away from this country less than 450 days?

OR due 7 month gap she need to wait till Dec 2011 and apply based on spouse of British citizen?

You are trying to query something which I am sure you know yourself. Read the application form and guidance again. Just calculate the absences counting backwards from the date you apply and work out the asbsenses. If you fit in, apply, if you dont, then dont apply.

By the way, where does it say in the application form or guidance that 7 months absence would disqualify someone for naturalisation?

Thanks for your reply.

Even I was thinking in the same way.

However someone told me that continuous absence should not be more than 180 days and that is why I have asked this query.

So from your reply I am assuming that there is not such requirement that continuous absence should not be more than 180 days and my wife will be eligible for citizenship in June 2011.
