hi. i would appreciate it if anyne who could help would help me. i was born in northern ire so am eligible for both a british and irish passport. i have always carried a british passport although i count myself as having dual citizenship. i met my wife 6 years ago while on holiday in jamaica. she got pregnant and our relationship started from there. we had another child and then a year ago we got married in jamaica. we have since had another child. she was refused visitor visas to the uk as they said her ties to jamaica were not strong enough. before we were married she applied for a settlement visa and we planned to marry in the uk. this was refused on the grounds that i was a student and could not support her financially or provide accomadation. they also questioned whether we intended to live as a married couple- they decided we didn't. we thought we would go ahead and get married in jamaica and apply again as husband and wife. since we were married i have started work as a doctor and have bought a four bedroom house. she subsequently applied for another settlement visa. this was refused on the grounds that the entry clearance officer did not beleive we intende to live as husband and wife. they based this on the fact that she did not remember the date we met and that she had no corrspondence from me-we talk on the phone using phonecards- no phone records. i have since applied for my irish passport which i now have. this was on the advice of my solicitor who has advised that she applies for a EEA family permit. she stats that the british cannot refuse this as i qualify as an EEA national(irish) working in another EEA counrty(UK). she has told me the only evidence i need to provide is a copy of my passport, my marriage certificate and a letter from my employers. due to the previous applications i am sceptical about this.what evidence can i provide them with to show them that we intend to live as a married couple- ihave read on their website that they can refuse if they do not believe you paln to live as a married couple. this is the grounds that previous applications have been refused on. i don't know if my marriage can survive another refusal. what evidence should i provide them with.
thnks for any advice you can provide me with.
ps-my oldest child is in the uk with me and holds an irish passport, my other two children are in jamaica with my wife and hold british passports
