New changes from 19th July

Post by s4salil » Mon Jul 19, 2010 6:28 pm

I have a valid Tier1 visa which is valid from 20th July 2010 ... but it was stamped in May 2010.
Will the new rules of 100 qualifying points be applicable to me while applying for the extension after 2 years?

Thanks for that.
But the date of application is nowhere mentioned on the visa vignette. Do I need to keep the visa application fees receipts ?
Or is it available with the BA once they have the visa ref number? should be that way logically!

The rules on the date of application (May 2010 in your case) will be applicable when extending. (if the Govt would not change this in future)

They will have all the details. Keeping your visa application fee receipts is also a good idea to be on a safer side.

I would like to know if this is documented in the policy guidance / immigration rules / UKBA website?

I am of the opinion that it might not be the case and have been looking for information (documented) in this regard ... but haven't found it yet. Maybe I haven't searched enough ..... hence the query.

I am not contradicting you, but trying to locate published information from UKBA in this regard (if there is any).

A para from - http://www.ukba.homeoffice.gov.uk/sitec ... test+news)

From 19 July 2010, the number of points required for an initial Tier 1 (General) application has increased from 95 to 100. Additionally:
the points awarded to those with previous earnings of £150,000 have increased from 75 to 80; and
the points awarded to those who have an eligible MBA have increased from 75 to 80.
These changes apply to all initial Tier 1 (General) applications paid for on or after 19 July 2010, whether they are made inside or outside the UK.
The points requirement will remain at 95 points for applicants who are currently in the UK under one of the following highly skilled worker categories:
Tier 1 (General)
Highly Skilled Migrant Programme
Self-employed lawyer
Writer, composer or artist

I agree with you Sush, I have assumed the above statement. The reason being, each the Govt. has made some changes they have put some transitional arrangements to people who already have Tier 1 / HSMP.

After changes in April 2010,
1. Points for Bachelor Degree or under 20000 will be 0 if they got tier 1 after 31 March 2009
2. Age banding will be one year lower for people switching from HSMP.

The above rules were at the time of their initial application and were also to be satisfied at the time of extension. Hence my assumption.
I agree with you that suggestions on this forum should be given on facts than assumptions. Thanks for pointing it out. My bad..

s4salil, I have a question. In your case, you've got your visa approved in May 2010, but it is valid from 20 Jul, did you request the validation starting date when you submitted your application or the visa officer decided it? What is the rule?

I am about to submit my Tier 1 application recently, but I can only move to the UK in Jan 2011, may I request a valid day starting from 1 Jan 2011 etc.?

Hope someone could help me, thanks!

You may request for a travel date which should be within 90 days from the date of your application.
