My wife and I are in the process of appealing a settlement visa rejection from the UK embassy in Bangkok.
The reason for the rejection are very weak in my view, they claim a mix up in dates to when we say our relationship started, also they claim that I was not in Thailand at certain times. I clearly was as the immigration stamps can be seen in my passport.
The visa agent that we have used to do the appeal for us claims that the case should be easy to get overturned in Bangkok, with the new evidence that we have given. But i have also seeked legal advise in the UK should the case go to tribunal. Where I also got the same advice to the rejection.
We are now 8 weeks into a process that can take 16 weeks if the visa will be overturned in Bangkok or so i am told, so hopefully we will not have long to wait now.
But my sister is getting married next month and i would like my wife to be here to go. Is they anyway or visa that my wife could apply for while we wait for the settlement appeal? That would allow her to come to the UK fr the a short time. I have seen that a family visit visa may work.
I understand that in most cases this would not be ideal, but if we where able to explain our case in the application. I feel that the reason that my wife would return to Thailand would be to collect her settlement visa should this come though. So she would not want to over stay and jepadise her settlement visa, would this reasoning work.
The other option that i can think of would be to withdraw the appeal, and just apply for a tourist visa to use at first and reapply for a settlement visa later. But again would records at the embassy not allow for this to be a success.
Because at the moment i am unable to be with my wife in the UK, and although i do visit her in Thailand work commitments and money do not allow me to stay there for much longer than 3 weeks at a time. The though of a 9 month wait just seems wrong for the reason of rejection given.
