Please help....very urgent!! Funds question

This question is in regards to a student visa. I have already completely paid all my course fees and accomodation fees and I have the certificate of Acceptance and everything that is required from the school. The only problem is the required funds for maintenance in my bank account have not been there for 28 days, I just had money put into my account that was owed to me and I NOW have the required money but it has not been there for 28 days...and if I wait another 28 days to go apply for the visa it will be cutting it VERY VERY close as classes start September 6th.

My question is is the maintenance requirement of the funds being in your bank account for 28 days AN ABSOLUTE REQUIREMENT? Is there any leeway or wiggle room on this requirement? Considering all my course fees and accomodation is FULLY paid and that I have the money now in my account, would a visa really be denied because of such an arbitrary rule like not having money in there for 28 consecutive days? What it comes down to is will not having money in there for the 28 days mean an absolute denial of the visa OR is it all up to the immigration officer?

Unless you want to risk a refusal and then waste time in administrative review, my suggestion would be that you follow the policy guidance to the last T.

I heard from somebody that the most important thing is the bank statement shows 28 days, and as long as the end amount is at or above the required amount then you are ok.

Any additional comments would be appreciated, again thanks to everyone.

Yes it is in short. You might get lucky if you apply and might get away with it, however if you're refused then there is very little you can do in the administrative review so I'm with sushdmehta on this one i'm afraid.

You mentioned that you have a short deadline. I would imagine it be better for you to apply when the 28-day period has passed and risk missing the starting few days of your term, which I'm sure your institution would understand, than risk a complete refusal and losing all that money, then having to apply all again and missing the start of your term anyway.

Not something you want to hear unfortunately but this is the best I can offer. Of course it is your decision at the end of the day and no one can tell you how likely you would succeed doing it the way you suggested but just remember that they are getting very tight with Tier 4 applications so caution is advised

a very high level official at the school I am a prospective student of told me clearly and concisely "all they care about is that the bank statement covers a period of 28 days, and as long as the amount at the end of those 28 days is at or above the required amount you are ok"

Was this person severely misinformed or something?

Is he in anyway connected to UKBA? Does he have any influence on any caseworker?

As I said, you might get away with it and there might indeed be some leeway that UKBA applies. The only problem is that this is all guess work. None of us know for sure whether this is true or not. We can only speculate from experience and no one has seen any official document to suggest so. Technically the money has to have been there for 28 days and if you're refused LtR then there is little you can complain about as this is the rule.

Nevertheless as I have said again, you can apply now and hope for the best or wait till you're fully eligible according the official rules, which will then afford you with more appeal rights if refused. The choice is yours.
