Very urgent help

Hi everybody,
I need a very big help from you ppl.
One of friends has come in tier 2 (work permit) visa with his family. It's been 3 months he is staying here. Now he is planning to apply for tier 1 general visa. He has not maintained enough fund for his wife and kid. So, he can't apply for dependent visa now.
I have one big doubt: What would the vise status of his wife and kid when his tier 2 visa changes to tier 1?

AFAIK, his dependents will have apply for leave to remain as dependents of Tier 1 (general) migrant within 28 days of him being granted Tier 1 status.

Thank you very much for your reply. But for dependent visa he is not having enough funds for the past 3 months since his arrival at UK. Now after 28 days can he apply? because even if he applies after 28 days he will in short for last two month maintenance fund. Will there be any legal issue if he applies after 3 months from now for his wife and kids?
