An overstay student depandand can in-country apply as a spouse again,please advice?

Difficult to answer without some details:

1. What was your immigration category? In one post you have mentioned that you were a student. Here you are stating that you were student dependent.
2. When did your leave expire? In other words, how long have you been overstaying in the UK?
3. What is the immigration status of your spouse?

Thanks sushdmehta for your reply.i am a student but this question not related with me,one of my friend,s.he is student and he extented his visa but in 24 june/10 his spouse refused and no right of appeal for out of time application.my friend and his spouse visa was expired feb/2010.unfortunately he applied for spouse march/2010.thanks for advise

The spouse (of the student) will need to return home and may reapply again for EC as dependent of Tier 4 (student) from home country. Please note that period spent in UK as overstayer may have a bearing on EC applications made in future.

What difference do you think such a phone call will make? Every applicant is entitled to seek legal advice - before, during or after submitting an application.

i got question too, i have a friend in uk he is on student visa last 5 year and his visa is finishing on dec 2010.as his wife is same on tire4 student is it possible he can switch his visa as dependent tire4 inside the uk or he must have come back and apply form his home country!
