Help Needed!! Refusal Fund Not covering 28 days.

Dear Fellow Immigration board member, My girlfiend applied for her visa, on 16th february, done her bio-metric on 20th march,
Just has recieved a letter that she her extention has been refused becoz she didnt schore 10 point for fund,

Now, Firstly they said she need 800x2 for london, where she does not live in london. Newport is not inner london at all.

Secondly her fathers Bank statement cover 1 dec to 15th feb has more then 10k to cover first year and mantainace also she send her own bank statement of 2k.

now UKBA says her statement and her dads statement does not show they have the possesion of money for 28 days. as we counted she had the money for about 22days, but her dad statement covers 3 month till feb,

As UKBA said there website they will calculate the money for the most favourable to the applicant, which is not in this case,
This is very confusing, any way they attached a apeal form and we are intending to apeal against it.

What would you suggest? I talked with a solicitor and the fees are like half year of my course fee. Is it sensible to go to hearing by ourself ?

Firstly, get your English grammer and sentence construction sorted out. I had to read it through thrice to get the gist of what you where trying to convey. Secondly, going to an appeal without a solicitor is your own personal decision. I did it once and it was fun, but I lost and that was that.. :roll: If you are able to present your case convincingly, then there is no problem at all.

1) In this case, your argument rests with trying to convince the judge that your girlfriend's father had money in his account for more than 28 days before the date of application. I think by law you would also have to get a letter from her dad stating that it is ok for his daughter to be using his money for her educational purposes.

2) Her 2K is not 28 days old, hence will not be considered in the appeal. So, you would have to prove that the 10K in her father's account is enough for her course fees and her maintenance during her period of study.

Not being a Britisher, I dont really know where Newport is. But it would be better if your 10K is enough to cover her maintenance in inner London as UKBA has stated in their refusal. Else, you would have to also prove in your appeal that Newport doesn't come in inner London which would get things more complicated.

Thanks for the Reply. We have made an appeal by ourself and won it. Now waiting for the home office to send her the ID card.
