Question regarding CAS start date

Question regarding CAS start date

Hi

My current leave (Tier 2 General) expires on 18th of September and I am planning to apply for a Tier 4 postgraduate course which starts on 19th of September. Will I be able to apply from inside the UK?

I found the below in the guide and need confirmation

"Students applying from inside the UK

If a student is already in the United Kingdom and his/her existing permission to stay runs out more than one month before the start-date of his/her proposed next course of study, he/she will be expected to return overseas and apply from outside the United Kingdom. If the applicant applies from inside the United Kingdom, his/her application will be refused. A month will be considered a calendar month (for example, if an applicant’s leave expires on 14 January his/her new course must start no later than 13 February)."

You aren't in UK as a student hence the statement you have quoted above doesn't apply to you. Tier 2 migrants can switch to Tier 4 (student) from within the UK.

Guess you need to apply ASAP, given the fact that your course starts in 6 weeks.

Hi sushdmehta

Thanks for the reply but I am not sure if I understand this, I am going to apply using the premium application option in 2 weeks time so I should have enough time, however since my current leave expires 1 day before the course start date, would I be able to apply without facing refusal due to current leave expiring a day before the course starts? Appreciate your clarification

No one but the caseworker can tell you whether your application will be approved or refused because that depends on you meeting the specified requirements and submitting evidence(s) to support your application. And do remember, premium in-person service does not guarantee same day approvals. The caseworker may refuse / defer a decision depending on the (lack of) evidences submitted.

This said, the law requires that you submit an application (by post or in-person) before the expiry of your current leave.

Thanks sushdmehta, I have all the required evidences therefore as long as my current leave date (I’ll apply before it expires) is not going be a reason for the refusal I hopefully should be able to get my student visa. I do take your advice regarding the decision making process based on the caseworker assessment of the evidences and the fact that the in person application can be deferred because of lack of evidences.
