Hi there

I met my now wife in March last year, and married in sept, appling for the settlement visa shortly after, providing the immigration people with all the evidence that they required, thinking that it would be a fairly straight forward thing and if you are married to somebody you should be able to live together without any doubt, but in late november it was refused so i went back out there and we lodged an appeal, don't have a clue what to do now, if i need to go to the court what i should say? But if the appeal is refused what do we do then thought about going out to her country to live for six months to show a commitment but then i have the problem of not being able to show an income or a residence. It would be possible for me to get a job guarentee on my return and probably something from my folks or a friend to guarentee her stay. But i think its ridiculas that shes not here already. Not sleeping really any help would be much appriecated.

Sorry to hear about the refusal. Are you able to give more detail about the grounds for the refusal? That is, why have they turned down the application?

And what country is your wife from?

They didn't give a reason on the refusal letter, She is of thai nationality, have heard a few things about people being able to guarentee her stay but how would i go about this and could i send this to the tribunal before the hearing to help.

They are required to give her a letter setting out the reason(s) for refusal. If she has not already had that then she needs to ask for it as a matter of urgency.

The point is that unless you know the grounds why the visa was refused you are totally in the dark as to how to combat whatever they say.
