Changing dependancy

Post by monamd » Thu Aug 05, 2010 9:28 pm

i am here on as a dependant on my dads student visa granted 2008 - expires in August 31st 2010.

my dad has recently switched his visa to a dependant of my mother;'s student visa which is valid until 2013.

I am 21 years old and still a dependant, i am working part time and have an offer at university.

will the fact that my father changed his dependancy to my mother have any affect on applying for further leave to remain as a dependant on my mothers visa?

i have just done some research on Rule 319H and it is this paragraph which is confusing me
(c) The applicant must be under the age of 18 on the date the application is made, or if over 18 and applying for leave to remain, must have, or have last been granted, leave as the child of a Relevant Points Based System Migrant or as the child of the parent who had leave under another category of these Rules and who has since been granted, or, is at the same time being granted, leave to remain as a Relevant Points Based System Migrant.
as my father was on a student visa in 2008, will this be regarded as the child of the parent of a relative PBS migrant, or alternatively now that he is a dependant on my mothers Tier 4 visa will he be viewd as someone who has had leave under another category but has now been granted leave to remain as a relevant PBS migrant?

please can some help, this is really urgent
