I am on Tier1 now and spouse still on Tier 2 - Any Issue??

Hello Guys,

I have recently switched my immigration category from Tier 2 working visa to Tier 1 General.

I could not apply spouse application along with mine. my old VISA Tier 2 (sponsored working visa) still valid upto 29th May 2011 (as i don’t see any stamp of cancellation or any remark on visa or passport so i assume its still valid).

I am not planning to apply spouse visa renewal until current visa expires , which will on 29th May 2011.

Do you think there is any issue or problem on this visa mismatch... or since i am on Tier 1 so spouse visa has already been cancelled/stopped and she have to apply for renewal ??

Any suggestion on this situation is much more appericiated.

It doesn't work the way you think.

Once you have switched over from Tier 2 to Tier 1, the earlier visa becomes invalidated. Thus invalidating any other dependants on your earlier visa.

If you are in-country, you have 28 days to apply for your wife's dependant visa on tier 1.

However, if you are out of country applicant, you would have your wife's visa switched over to your most recent.

Your wife's not an independent identity with regards to visa, she's dependant on your visa. So if you are no longer on tier 2 how can she be continue to be on dependant on Tier 2.

I did not know about this? this means i have to rush to apply her visa into Tier 1.

I received my visa few days back But still its under 4 weeks range.
I believe on your expertise and will start the process as soon as possible.

we both are in-country.

am sure. I read about this 28 days validity somewhere. Will try to dig out and post the link.

But, if you think logically, it does makes sense, how can your wife be dependant on Tier 2 visa whereas you are on Tier 1. A dependant is always linked to main applicant visa.

Hope this makes sense.
