ILR - Dependent Query

Hi,
I came to UK in 2006 on HSMP for 2 yrs and then got my Visa extended in 2008 to Tier1.
Currently I am covered by the HSMP JR and hence I am eligible for ILR in Oct2011.

I got married in 2009 and my husband got his Tier1 General Partner visa in Dec 2009.
But due the current job situation here,there are no jobs matching his profile here and so he went back to after spending few months searching for a job here.We are on the constant look out for jobs, but still havent managed to find one.So am really not sure when he will join me.

The doubt I have is, since I am covered by HSMP Jr(Pre Nov 2006), I read that my husband will also be eligible for ILR at the same time as me(there is no 2 year limit).So if he enter UK few months before the ILR time, will he still get his ILR.

Somebody Please clarify.

Hi Sushdmehta,
Thanks for the post.

I just realised that when we applied for my husband's visa, we had used VAF10 instead of VAF2 forms.So his Visa stamping says Tier 1 General Migrant Partner.

After read lots of links in the forum, am confused now.Will he be eligilble for ILR at the same time as me.Please clarify.

Is there anything we could do to rectify this?..
