Tier 1 dependent, court hearing appeal

Post by Son_of_Soil » Tue Aug 17, 2010 1:21 pm

HI
My wife applied for Tier 1 dependent from india in april this year, she got refused for two points:

1) her bank statemenrs were more than 30 days old from the date of application
2)my bank statement( which was a joint account with my dad), The entry clearence officer couldnt establish the relation between the account holdre.

I had sent home office a letter from my bank in india confirming the relations between me and my dad.

I had logded an appeal , and yesterday i got a letter that the hearing will take palce on 8th october,
Just want to know is there anything that i need to be aware of? my solicitor will be present aswell. Does anyone know how long court takes to decide wheather visa should be given or not?

appreciate it

Depends on the evidence(s) presented to the court/ judge. The judge may decide on the application on the same day or may defer a decision (usually the former).

When will BHC get a copy of the decision (approval) and act on it (write to your dependent to submit passport for stamping) is another matter. From the posts in the forum it seems that this step can be time consuming.

my wife's statments were not required as my joint statment had sufficient funds as maintenance money. so am not sure if thats gona be a problem.
