Tier 1 General, VISA REFUSED, PLEASE HELP !!!

Hello everybody,

One of my friends applied for Tier 1 General Visa from within the country but his visa has been refused. HO hasn't granted him points for previous earnings. He sent application form on 19th of July 2010 by claiming points from salaried employment and as self-employed IT Support Technician.

HO has accepted his salaried employment details but refused points on self employment. He sent letter from accountant , profit and loss account and also invoices to HO but Invoices were not attested by accountant.

He also sent Bank statements for whole year from both salaried employment and as self-employment to support his financial conditions.

Refusal also says he doesn't have right to appeal and as application was an in-country so he cannot go for admin review.

Could you please provide assistance as what he should do now?

To my understanding they have refused visa as invoices were not attested but bank statements could also be considered as second proof. Although he sent only one copy of bank statements but they covered both salaried and self-employed transactions.

As evidence of your previous earnings from your self employment you have provided Accounts, Accountants Letter and Invoices

As you have not supplied a further two types of documents from section 142 of the guidance, as evidence of these earnings, we are unable to award points for these earnings.

We have therefore only been able to corroborate your earnings of ***** from (Company). This is below the point scoring range and we have therefore been unable to award points, in line with published guidance.

yes if you are self employed in UK then you need to produce 2 more documents from below list:

1 Employers Liability Insurance from an authorised insurer.
2 Proof of registration with HM Revenue & Customs (HMRC) as self employed
3 Evidence of Registration with HM Revenue & Customs (HMRC) as an employer to pay PAYE & National Insurance.
4 Certificate of VAT registration and latest VAT return confirming VAT registration number.
5 Latest Annual self-assessment tax return to HM Revenue & Customs (HMRC) - Statement of Account (SA300 or SA302).
6 Latest Corporate/Business Bank Statement along with a letter from the Bank setting out the dealings it has had with the organisation, including the nature and duration of its dealings.
7 Proof of ownership of Business Premises and other Fixed Assets or Proof of Lease of Business Premises

So if you have shown self employed income of UK then the case worker is correct.

Nothing can be done, as you did not provide other two evidence in support of paragraph 142.

Only option is to Reapply with and meet the current criteria.
