Hi All,
i wonder if someone can guide me in this situation ,right,
i fall in hsmp jr ,my ilr suppose to due in nov 2010 after 4 years,
i stayed outside uk in patches i.e (2008 and 2009 specially), 5 month in one go, then came back to uk then spent 3 months here went outside uk for 6 months then stayed short here in uk went outside uk for 3 months ,total is approx 450 days out side uk in 2008 and 2009(2007 and now 2010 completely stayed in uk).
my question is how can i cover this gap in term of economically active and will case worker give any exception under jr (as i was working before with overseas company as a salaried person and showed my tax returns from overseas for 1 year in 2007 and got my extension at that time ) ,
now can i show myself as a free lance consultant (self employed)from 2008 to uptill now 2010 and try to register with HRM as a self employed(2008-2010) and pay the tax here with fine .(as u know before i payed in overseas) can i show overseas tax return still or not.
still attached with previous company as a consultant.
i am married with two dependents (child born in UK)
Plz Plz advie me ,i will be realy great full to u guys,this is my first post .

The absences are more than the allowed limit of 90 days per single trip. Also, earnings outside the UK during the absences are evidence of break in residency. The fact that you claimed points for such overseas income to extend your leave as HSMP migrant may also go against you from a settlement perspective.

When did you apply for HSMP approval? Before 03-Apr-06 or after?

Since you said that you would complete 4 years in Nov.10, I wondered if you had applied for HSMP approval between Apr06-Nov06! Hence the question.

It will help others to suggest if you can list your absences (with dates) and provide information - whether absence due to personal / annual leave or business, employment in the UK during these absences (if any) and whether your salary was paid in the UK or abroad - for each of the absences.
