Spouse Visa application ? confused

Hi

I am a british national, married and currently based in Dublin with my wife.

I am planning to move to UK with my spouse. I have a few questions regarding the spouse visa.

1) Do i need to have a job in UK before i move there?

2)My family owns a property in UK, which i plan to provide as my residence in the application is this acceptable ?

3)With regards to funds, what is the minimum requirement for funds that needs to be shown? Can a family member sponsor or perhaps provide guaranty?

4) I am an accountant and plan to secure a job before i move, in case it doesnt work out, what are the chances that the spouce application will get approved?

1) Yes or if you have significant savings that will keep you both going for about 6 months. Most people get jobs first to make sure they cover all the bases.

2) Yes but you will need a letter from whoever owns it that states they don't mind you living there and you need to prove they own it.

3)No min requirement but you do need to be making more than you would in benefits as a couple so about £103/week after rent and council tax. Third party support is kind of allowed but not really. It hasn't changed in the guidance yet so I wouldn't rely on any or say that you are in the app.

4) Good if you have savings. Pretty much none if you don't.

chursy, are you working in Dublin? Are you going to be looking for work in the UK and what are your chances of finding a job?

Your wife may have the option of applying for a free "Family Permit" under European law to enter the UK.

Search this forum for "Surinder Singh", which is the name of the case that covers British citizens returning to the UK after exercising European free movement rights.

What nationality is your wife?

thanks for your above response. .

I am currently working in dublin and will be looking for a job in UK, chances are good and hopefully shouldn't be too much of a problem,being a chartered accountant.

My wife is a pakistani national.

I have had a quick search on the family permit, on homeoffice website and on the surinder singh case. Reading the facts i believe i will qualify for this permit. However i am a little conffused as to , can i apply for family permit even if i want to visit UK with my wife? it mentions on the website that i should apply for this instead of a visit visa.

My understanding is that its issues for a 6 month period,so therefore on a settlement basis when i shall be returning back to UK, will i applying for a settlement visa,valid for 2 years, after the 6 month period is expired on this visa?

OK i found out after the residence permit i can apply for the residence card for my wife valid for 5 years after which she can apply for permanant residence. However my understanding is through the settlement visa she can get indefinite after two years? is this correct?

in which case would it be better to go for the settle visa endorement for 2 years?

Correct. Under present UK regulations permanent residency (ILR) is 2 years.
