COMPLEX ....legal advise.overseas

if a british citizen run to overseas ,in this case pakistan to be with fiancee .and marry her fiancee in pakistan
so that her parents cant force her into anything !

and then her life and her partners life is in danger in pak (threats n etc) , how are they eligible to apply to BHC ? for protection or on human right grounds?

offcourse the british citizen can come uk anytime , what about the partner ??

shes not goin for force marriage , shes going for love marraige
bt her family dusnt approve of it !

they guy she wana marry is in pak ,

If she is in trouble she can contact relevant dept?Not a big deal.
After all she is adult not a child.

You can not force people to not apply for visa.

It is for home office to decide grant visa or not.

You dont need to worry for his visa.

Forced marriage happens frequently enough in Pakistan that they have a full time unit at the BHC in Islamabad to help victims.

I know a couple of victims by the way.

This is not really a valid reason for an asylum case.

How old is she by the way?

They can apply for a spousal visa after they marry in pakistan.

This isn't a case of a British citizen being forced into a marriage but that of a Pakistani national who is afraid of (potential) threat on life by family / community / tribe subsequent to his / her marriage to a British national against family's wishes.

I have my doubts if this will fall under FMU remit.

I cannot see why the BHC would not help a citizen who is at risk. And yes, I know of cases where, although the circumstances are not exactly the same, the FMU have helped.

There are no suggestion that force marriage is going to happen.
This gentleman is a third party(not person concerned) and there is no suggestion that British person life is at risk.

we are working on assumptions.

As I said she is adult not a child so she can contact embassy or police if she needs help.

ok guys i am their mutual friend . they are both cousins and their families because of their personal issues and other ego problems do not want them to marry .
the guy was in uk for 2 years ( pakistani national) , but they could not marry as he was under 21 . he had to go back .

now there only option to get married is by leaving their respective families , and marry somewhere in pakistan , but they do understand their lives will be at risk because of both their parents.

what can they do in such circumstances /> just hide?
spouse visa was an option if the girl was in uk , working full time and living , since she was living with her parents , n she ran away that wont be posibble , its a risk to her life to go back to her family!

FMU remit ? what exactly is that ? Any other way out ??

Your friends should ring and see if they can offer any advice. Doesn't mean that he would necessarily get a spouse visa without meeting the rules just by ringing the Forced Marriage Unit.
