Problem importing non eea family member from Cameroon

Hi,Guys
Can you help me out here?? Im an EEA National married to a Non EEA National and living in the UK whereby Her permit ran our in 04.
To complicate matters more We both travel between UK and Ireland where she has residency. Up to now there has not been any problem.

But now We want to bring Her daughter from Cameroon on an EEA Family Permit to the Uk but are being stonewalled with red tape ie No visa for UK.

I have Dual Nationality with both Passports British & Irish. I live in Britain
with my Wife who I now find is an illegal or overstayer I dont know which
and we both work in Ireland during the week and travel home weekends.

My daughters permit is being held because Her Mam has no valid visa for UK.

If Im the EEA National asking for my daughter to live with us why do they need my wifes valid stay She has one for Ireland which is another EEA state

Does She have to return to Cameroon and apply again for a permit or what ????

Even if your wife has a valid visa for the Republic of Ireland that gives her no rights to enter the UK. She really does need an EEA Family Permit. Given that she has the visa making her legal in Ireland the British Embassy in Dublin should entertain the application for her EEA Family Permit.

OK we know that in practice there are few border checks between the Republic and NI. But nevertheless your wife should not be crossing the line into NI without the EEA Family Permit in her passport. She should apply ASAP and use form VAF1 for the purpose. No application fee.

Once your wife has her EEA Family Permit you can proceed to get an EEA Family Permit for her daughter, that is, your step-daughter.

The original poster may not be aware of the fact that with an EEA Family Permit it takes five years to get permanent residence in the UK, as opposed to only two years with a regular spouse visa (and sometimes immediate settlement).

He should consider the option of a regular spouse visa for this reason alone, either as an alternative to the EEA Family Permit, or as an "in-country" application after arriving in the UK (noting that immediate settlement may not be available from an "in-country" application).

Also - if the original poster is an Irish citizen, and then spouse has been resident in the Republic of Ireland, have they looked at the option of the spouse becoming a naturalised Irish citizen?
