ILR Qualifying and entering question

Hi all, I have looked through the board for an answer and I guess it is there somewhere but not as yet found it.

My wife is due to apply for ILR on a spouse visa, it was stamped in Kenya on the 6th November 2008, but she did not enter UK until the 14th December 2008 a period of more than 28 days.

Does she need to apply for extension of visa as if we applied no more thamn 28 days before the entry date 14/12/2010 then that would be 16/11/2010 which is over 2 years from the date of visa being stamped in Nairobi 06/11/2008.

We would prefer not to have to extend, if need be what would it involve? extra costs plus lots more evidence gathering?

Your advice on this matter would be graetfully welcome.

Check your visa for the expiry date. Previously they were issued for only 24 months, but they have been issued at 27 months also.

My husband recieved his visa 27th Jan 2009 and it is valid until 29th April 2011. So check its validity period. If you have a 27 month visa you will be fine to apply on the 16/11/2010 and will not need to extend it.

There is a special concession for spouse (2-year) visa holders.

She may apply (by post) for ILR before her leave expires. KOL required.
