ILE validity date in my daughter passport

Post by gg234 » Mon Jun 14, 2010 11:47 am

Guys,

I really need some expert ans regarding ILE validity date in my daughters passport

I had applied settlement visa for my wife and daughter (1.5 years old) in May 2009 while i was on ILR (Now i am british citizen) both of them granted 27 months visa.In my daughters visa says Indefinite leave to enter with validity of 27 months which is strange for me (It should say same date as my daughters last date of passport validity)

I have check this link http://www.ukvisas.gov.uk/en/ecg/ecbasi ... y#12426421 where it says

ECB9.6 Indefinite Leave to Enter (ILE) and Indefinite Leave to Remain (ILR)

Applicants who are granted Indefinite Leave to Enter (ILE) at a visa issuing Post should have no time restrictions on their stay in the UK ie they can stay indefinitely. ILE carries the same entitlement as “Indefinite Leave to Remainâ€

ILE Expires in 2 years ?

Post by memofofo » Wed Sep 08, 2010 10:55 am

Hi,
I have similar condition of your Daughter. I am the husband of British National married for 5 years now. I just got Indefinite Leave to enter Visa but for 24 month only. My passport expires in 6 years time.

I dont know how to explain this in light of the regulations
"ECB9.6 Indefinite Leave to Enter (ILE) and Indefinite Leave to Remain (ILR)"

I am not sure but I think I can apply for ILR once I am in the UK. After residing in Uk for 3 years, I can apply for citizenship.

Did you manage to get any feedback afterwards. I hope someone can help us on this.

What is Next ?

Post by memofofo » Wed Sep 08, 2010 11:14 am

Thanks vinny for the very quick reply. I did read the regulation. The same regulation is saying that ILE should be issued until the expiry date of the passport which is in my case 6 years. ILE was issued for 24 month only

What happens if I stay after ILE expires in 2 years ? Am I breaking the settlement law. If I dont have to apply for ILR, how can I then transfer ILE --> ILR in UK ?

Hope you can guide me on this please. Very much appreciated.

When in the UK, indefinite leave, by definition, will not expire. Did you satisfy the KOL requirements before getting the ILE?

However, if you wish, you may have the endorsement corrected.
