Hi, i'm in a bit of a situation and would appreciate any advice with regards to the following:
My wife and i married in 06, i am a british born citizen. She was issued her settlement visa in feb 08 but entered the uk in april 08. When planning to apply for ILR in april 2010 i noticed the visa had obviously expired in feb, but i had drilled april in my mind.
I then read through the form carefully and noticed one of the requirements was to have passed the citizenship test. This was obviously going to cause more delay. So we bought the book and she revised and passed the exam in july.
Now she has overstayed 7months, and is 6 months pregnant i am really worried about the result of applying. I called immigration and they said i should include a cover letter explaining why we applied so late and it is at their discretion whether she is accepted or not. Will the fact that shes 6 months pregnant affect the chance of deportation? I am also working part time and claiming housing benefits.
So worried i cant even tell you. Such an idiot for not applying and thinking ahead.
