what should I do, should retreive ILR?

Hi there:

I have send out ‘Indefinite Leave to Remain’ application before my student VISA ended 30.10.2009.

which means I currently do not have status in the UK, and have not heard back from the ‘Indefinite Leave to Remain’ application from the government yet.

As I know, I’m eligible to apply for ‘Post Study Work’ visa within one year from when the course ended.

My course ended 2009 November, which means if I have to apply, I have to apply before 2010 November, which is just about 2 months away.

What do you think the best thing to do now is?

1) Let the ILR application process carry on, or

2) retrieve my passport to apply for Post Study Work PSW, but

3) if retreive my passport now, and apply for PSW, would I have problem getting the PSW visa due to not having a status at the moment


Please let me know your view on this matter.

It is very urgent please help.

If you make an application before your authorised stay ends, your existing immigration status will continue until your application is decided, even if the decision is not made until after the end of your permitted stay. If your existing visa or other permission to stay here allows you to work, you can continue to do so until your case is decided.

If you withdraw your (settlement under long residence) application, then you will have no legal right to remain in the UK and any other application for leave to remain (e.g. - PSW) may be refused for the same reason.

Alternatively, you may withdraw the application and return to home country as soon as you get you passport back to apply for Tier 1 (PSW) from home country. The disadvantage of taking this route is that this will break your "continuous lawful residence" in the UK and reset your ILR clock (long residence) to zero.

- Find your MP and get MP's contact details.
- Then call MP's office and get an appointment to visit in person, or write a letter (or email).
- Time depends on your determinacy as well as MP's efficiency in assisting you.
