Do immigration officer in UK has the right to stop a student whose course has finished but still hv visa for another 10 weeks?

Hi

My masters course is finishing on 30-sept-2010, result will come out on 18-nov-2010, convocation of my degree on end of jan 2011 and my visa expires on 02-feb-2011 and m planning to apply for PSW. But before tht m planning to go to india for holidays say 04-oct nd will cm bck on 12-nov-2010.

My question is can immigration officer stop me while cmin back to birmingam? I need serious and legal advise if anybody can give as i dont want to take any risk.

Hi Himanshu,

just chill dont worry they wont stop you. if they stop you, as you didnt get the certi and attended convocation you are free to enter in UK.

so dont worry mate, u r a free bird to go...

the thing is i hv consulted in my university(international office) and they also sayin that there is a risk because u won't hv any genuine reason to come back as ur course has been finished and as far as result is concerned u can get in india also. After this m more concerned :(

Im discussing this in this forum so that i can make right decision so plz feel free to discuss

May be subject to refusal under 323(ii).

I woudn't risk it and change my holiday plans if I were you. They can refuse you.

thank u so much sir. As I dont want to take any risk I will nt go to india untill i get my PSW.

I found this on UKBA website, subject to refusal under 323(ii) if he ceases to meet the requirements of the Rules under which his leave to enter or remain was granted

Yeah ur right I just wanted a strong evidence on the topic which i hv now.

I think this is serious topic as i hv discussed with many uni students and nobody is aware of it.
