Seems some confusion in calculating the 28 days for AR

Post by vikrant123 » Mon Sep 13, 2010 9:57 am

To All the senior members of this forum:

I am also waiting for the AR result: I received acklgmnt after 7 days or a week.

As its stated on the AR Notice:

***** We will aim to let you have the result of the review within 28 days. If, in exceptional circumstances, we are unable to complete the Administrative Review within the 28 days we will notify you in writing as to when to expect a decision. *****

Does it mean, do they take 28 working days? If we calculate these 28 working days, it comes to 6 weeks from the date of filing the AR.

The caseworkers work 5 working days in week, so 28 days actually comes as 20 working days excluding holidays/weekend.

I emailed them and they said that received my AR request and and it is currently being processed.
but i wonder why AR take that long time! are they send it to the head office in UK,or they verify all the documents over and over, if they refuse the application because of one section that mean they should be working in that point only or what?.

The timelines invloved depends on various factors e.g. - workload, staff strength etc. And don't be surprised if you do not hear anything in the 28 days. You may just receive the decision (as and when a review is undertaken and decision taken).

regards
For all practical purposes, consider working days. There is no compulsion to decide an AR within the stated time period.

Chances of successful AR

Post by vikrant123 » Wed Sep 15, 2010 9:46 am

Hi All,

Big thanks to sushdmehta for replying but have got a few more queries for you.........

What are the chances of successful AR? What is the percentage of AR getting successful?

Caseworkers taking too much time, is it coz of peak period or busy time as student visa is on the top at the moment, atleast for the month of Sep.

I filed my AR on Sep 2, 2010, I have received the Acknowledgment on Sep 11 dated sep 8 by BHC new delhi, so now how many weeks do I have to wait for the result?

They refused my application initially with 245 C and 320 b considering that I worked more than a year on Working Holiday Maker Visa, which is not true.

For more info on my case:

http://www.immigrationboards.com/viewto ... 009#406009

I have received a letter from my employer as well stating my salary breakup and the last day of my employment in UK.

I stil have 9 months valid WHM visa, which is not cancelled, wil there be any issues if I travel to UK? Coz they refused me specially with 320 b

Looking forward to hear from all of you.

Vikrant

vikrant123, wait patiently! There is no obligation for the BHC to decide on your AR within a stipulated timeline.

No one can predict for you the chances of success / failure of your AR.

Hi sushdmehta, what is the prosses method to use in AR requst? I mean they are verifiy whole file or they just focus on refusal section, is there any group or committe for chaking all AR requst or it's taking by individualy? ECM chaking all AR requst? and last how they inform us abt our AR result, send mail, courior or by post? Thanks

Hi sushdmehta,

Thanks again for your kind response, I really dont know why caseworkers take more than 28 days but I have been going thru the most of the posts on this board, however, I have been failed to see if anyone has received Admin Review decision in just 28 days except the lucky one "krishna153" who received the result in just 14 days.

Sorry for keep puting queries for you:

1. I have been maintaining £3000 in my account in UK since march 19, 2010, which is still there in my account, is it fine if I take account £500 from my account, will this be an issue in my Admin Review?

2. When is the best time to contact BHC to know the status of AR? after 3 weeks or after 4 weeks?

3. I stil have 9 months valid WHM visa, which is not cancelled, wil there be any issues if I travel to UK? Coz they refused me specially with 320 b

Thanks again in advance, looking forward to hear from you.

Vikrant

All,
My application got rejected today. ECO Comment: You dont have enough points.

I have claimed 30 points for my previous earnings and they have given only 25 points.

1. I have submitted my HP pay slips till June 2010 and the last salary was credited on 12th of July.

2. I have submitted auditor letter for June and july 2010 and the amount was credited on 15th of July.

They have taken onanda rate for both the salaries on 31st of July.

Please advise, whether I can go ahead with my admin review.

Please guys i need your assistance for the accountant letter .
I am working as contractor self employed .
In the guidance they require as contractor to show two evidence
1:-* an accountant's letter confirming a breakdown of my gross and net
earnings for the period claimed; and
* personal bank statements clearly highlighting all credit payments
made to my account from employment undertaken during the earnings period claimed.

are they assessing the earnings by means of gross or net .
Thanks

Hi somsom2010, really sorry top hear about you. However, I believe, you need to some professional help, you should be in touch with some professional immigration lawyer or consultant rather doing it on your own. Coz we can never predict what an ECO is specially looking for?

Which city are you applying from?

Shah1507: Are you sure about 56 dayz of process?

I sent my AR on Sep 2 and I have received the Acknowledgment on Sep 11 dated sep 8 by BHC new delhi.

If we consider the case of somsom2010, he applied for AR on 24/08/2010 and his result was taken on 07/09/2010, unfortunately, it was not in his favor.

Vikrant

Hi Guys, even I have sent my application on 3rd Sept. received acknowledgment on 6th thereafter no news, as per Shah 1507 I tried calling mumbai BDHC , as I have also applied at the same post, its been 2 days I get the same "user busy" message after calling on to their number, I don't know whats wrong with them, in fact administrative review used to be quite fast, it was the matter of 10-12 days max, till last month at least..

hi Vikrant 123,
correct me if I am wrong, but, your post about somsom's timeline implies that if the Admin review takes longer time then there are more chances of positive results or something...
