Administrative Review - Can we apply for Visitor Visa?

Hi,

I recently applied for Tier 1 (General) but received a refusal (Administrative Review).

Please can someone explain if this means I will be banned from the UK for next 10 years? I read somewhere that if your application is refused then you are banned for 10 years? Reason for refusal states that case worker isn't satisfied with points earned for prior earnings and given the right to admin review.

My company has recently asked me to visit the UK and I wanted to apply for a visitor Visa next week. Is it possible for me to apply for a visitor visa whilst I apply for an administrative review?

1. No ban, just a simple refusal - unless the refusal confirms imposition of any such ban.
2. Yes, but how long do you intend to be in the UK on this intended "visit"?

Visitor Visa during AR

Hi Sushdmehta,

thanks for your prompt reply, it's helped me out tremendously.

I have travelled to the UK 4 times in the past being sponsored by my company for a project.

Similarly, I am in the process of undertaking a new project and require to be in the UK for 2 weeks to undergo training.

The intended visit will be for 2 weeks this time.

Will I be able to apply for a visitor visa ASAP and then AR once I return? Would I have to submit my passport again during the AR or will they ask for it later?

I don't want to apply for AR now if they require me to submit my passport again as this will limit my visit overseas.

Also, is there a time frame by which I must apply for a AR or can i do this after a month?

AR must be submitted within 28 days of receiving the refusal notice. Passport is not be submitted when submitting AR. As and when a decision is made and if the refusal is overturned BHC will request you to submit the passport.

You will be fine as long as you are back in home country in time to submit your passport when such a request is made by BHC subsequent to a positive AR decision.

I would suggest that you to apply for visit visa ASAP and submit AR as soon as you receive your passport back. If all paperwork is in order, the visit visa should not take more than 5 working days to be approved and you should have your passport back within the 28 days period.

In case you don't get the passport back within the 28 days time (to submit AR), do submit the AR even if visit visa is still under process.

Do remember to mention Tier 1 refusal in the visit visa application (or any other future visa applications).

Thanks for the above info.

I am just filling in the visitor visa applicatin and will apply for this tomorrow as my company is keen on having me there week commencing 27th Sept. Fingers crossed that the recent Tier 1 refusal doesn't play spoil sport.

Next question please: What all documents will I have to submit for the AR? Will I have to submit the Qualification, IELTs etc all ove again or just the info about earnings (as this is what they've refused the application on).

I applied for my Visitor Visa yesterday. Fingers crossed that my recent refusal of Tier 1 won't have any bearing on it.
