what visa should I go for??

Post by anastacia7 » Tue Sep 21, 2010 9:03 am

Hello everyone
I m really not sure what visa should I go for.
My fiancee is from Pakistan and is in the Uk on Tier 1 visa.
We want to get married here but I m not sure what visa should I apply for.
Visitor for marriage visa or a fiancee visa.
Also yesterday we called the register office but been told we need to do it in Swansea cuz here they dont do it for people from abroad.
And also we cant book the date because i m here on visitor visa and he hasnt got COA yet.
but for COA we need my visa.
So if i apply for visitor for marriage visa and come here to marry him and than i ll have to go back in my country and apply for a dependant?
and if i apply for fiancee i can switch to dependant here ?
can anyone tell me if this s true.
none of us is european or british citizen ,and we cant go in pakistan to gt married ,i already got my ticket for back.

thanks a lot

Unfortunately, you do not qualify for a fiancé(e) visa as your partner is not British, nor settled nor an EEA national.

You may apply for a Special Visitor: Marriage/Civil partnership visit (not settlement) visa. However, this may be subject to Frequency and duration of visits. Your fiancée may apply for a COA.

Alternatively, consider marrying outside the UK.

After marriage, you may apply for a dependant visa from your country.

If you are going back on monday, you can't apply for a COA and you can't get married in Pakistan as you have said. I think the options are to apply for a fiance visa from Pakistan, then you can get married here without the need for a CoA but only if your partner have a settled status(ILR or BC).

What is stopping your partner on a tier 1 from travelling down to Pakistan to get married, then you can apply as a dependant?
