Regulation 33 of the Immigration and Nationality £100

Post by chriseverclear » Thu Sep 23, 2010 7:21 pm

Hi All,

I was wondering if you can answer me a simple question. I applied for a british citizenship and was rejected because it is less than 6 years. When i initially look at the guide, it says 5 years but after several pages...you will see a small print that stated 5 years..you will become permanent resident and then i have to wait 12 more months. It is a bit ridicules.

Anyway, i was reject on July 2010. I asked them if i am eligible regulation 33 and just pay £100 to re-apply. They say no...i have to pay full amount.

My question is this. According to the regulation, the law came into force on april 6 2010. Why am i not eligible. They say that it would have been fine if i was rejected after september 2010.

Any advice? or do i just need to pay a full amount. Do we have a say?

Immigration time restrictions wrote:You must be free from immigration time restrictions when you apply for naturalisation. Unless you are married to or the civil partner of a British citizen, you should have been free from immigration time restrictions during the last 12 months of the residential qualifying period.
Why do you believe a reconsideration will overturn the decision when you have clearly failed to fulfil one of the standard requirements at the time of application? A review will not change the decision (which seems correct, based on information posted). And therefore you may need to apply again (fresh application).
