What date did you enter the UK on your spouse visa? You can't apply any earlier than 28 days before the 2nd anniversary of when you first arrived.
If you are unable to pass the Life in the UK test you can apply for Further Leave to Remain -FLR(M) instead of ILR.

i will be allowedto apply for my ILR on the 5 of december as it will be 28 days before the second anniversary of being here in the uk
