Hi there~ I have made my Tier 4 visa application on the begging of September 2010. But I recieved a letter from Homeoffice saying the Refusal to vary leave or variation of leave.
The reason they give me of the refusal is the secretarty of states is not satisfied that i have a valid CAS as there's no evidence on the CAS showing that I have passed an English test.
The situation is I have stayed in the UK for over 3 years, and when I first started my Higher National Certificate course in the college, I have used an IELTS 6.5 points ( which is 3 years ago) to apply for it. Though my IELTs results has expired, but I have been using English throughout my life here in the UK, and I have never left UK for more than 2 monthes.
I went to my college, the administrator told me that I must raise an appeal against the refusal, as I had all my courses passed , part of them were Distinction or Merit, so it is clearly that my English is far enough for the Higher National Diploma course that I am going to do this year. Also, on the CAS letter, the college declared the documents used to confirm the offer is I am applying to continue a course of study for which my last grant of leave was made, and I am a continuing student. The college insist that this is the UKBA's fault.
So far, I have registered for the English Test today and still waiting for my user name and password sent to my mail box, as soon as I get those, I will make an appointment to take the English test, hopfully I will get a seat within the week.
The question is, Should I wait until I recieved my English test result, then I post both the result and the Appealing form to the Home Office
OR should I do something else?
