STUDENT VISA REFUSED AFTER 21 MONTHS(CCL LINK)

Post by prince.07 » Tue Oct 12, 2010 5:23 pm

Please, can someone help me in this forum? I applied for my student visa extension in December 2008 with Cambridge College Learning Business Management progress result. To my utmost surprise it was finally refused on the 30th September, 2010 on deception with right of appeal after 21 months of waiting. Since the submission of my application in December, 2008, i have been studying. At present, am about to finish my Masters programme in one of the UK universities.

My question is;

whats the chance of winning the appeal?

You advice will be highly appreciated.

Thank you

You are in trouble, I'm afraid.

the AIT has concluded that the CCOL never ran such a course, and that anyone relying on it is fraudulent.

Accordingly for a person applying for leave to remain under the Tier 1 (Post-Study Work) scheme to rely on a certificate of an award of such a diploma following a course will amount to a false representation and so will fall foul of para 322(1A) of the Statement of Changes in Immigration Rules HC 395. Such a person will also be unable to meet the requirements of para 245Z because he or she could never have undertaken such a course.
I am not, and cannot, offer legal advice to particular people. I can only discuss general areas of immigration law.

People should always consider obtaining professional advice about their own particular circumstances.
