Change of visa

Post by fmb » Sat Oct 16, 2010 3:02 pm

My husband (Turkish) has previously had (4) and currently has a 6mth visitor visa.
We married earlier this year and i moved there to live and work however we have recently had a few family issues in the UK that have required us to come back and fix. Unfortunatley they are not all fixable and i feel it is better that we remain in the UK for the next few years.
With this in mind would be be able to apply from the UK for a change of visa, as soon as i get work here, or his he required to return to Turkey, apply their and wait it out apart?
As we had no intention of leaving Turkey (i havent told my Turkish employer work i do not intend to return as yet) im affraid we never thought this through as a scenarios before now.

Thanks in advance

Unfortunately your husband is unable to switch from visitor to Spouse settlement from within the UK. He will need to return to Turkey and apply on form VAF4a.
Make sure he doesn't overstay his visitor visa as it will only complicate the settlement visa application. If he applies after the end of November he will have to comply with the new English pre-entry test.

Casa thanks for your prompt reply.

Do you know if there is a set amount of time i should be in UK employment before the application will be considered? As i will need to find employment in the UK with a new employer before raising the application and do not wish to waste time and effort if it wont be considered for a set period of time.

My Moroccan husband I were in a similar situation to yours, apart from the fact that we applied for his Spouse visa before returning to the UK. We were living in Spain and he was granted a settlement visa purely on the written offer of employment for us both. Mine alone in fact would have been sufficient. So, considering this, if you have permanent employment, preferably with a letter confirming this from your employer and have adequate accommodation, the length of employment shouldn't be a problem. All the ECO will be concerned about is that you'll be self-supporting financially and that you won't need to claim Public Funds
Do you have any savings? If you're concerned about submitting a watertight application you may want to consider instructing an OISC Registered Immigration advisor in the UK to act on your behalf.
