Student visa for wife and Husband on Tier 1 already in UK

Post by jagankumar » Mon Oct 18, 2010 4:46 pm

Hi All,
I came to UK under Tier1 visa 2 months back.
My spouse is planning to come to the UK for doing her masters in University of sheffield MSc under the Tier 4 student visa.

We are clear on apply for tier4 student visa, so then she would not be on Tier1 dependant visa.
Anyways while filling up her visa application, she needs to mention that shez married and my profession and other details.
How can we overcome the question of why shez not applying for a Hsmp dependant and instead applying for the student visa?
How do i have to give the covering letter explaining this situation?
Will there be any issues on doing this?
Kindly help us in this regard

Why exactly did she decide to apply for tier 4 instead?
I tell it like it is.

1)My HSMP Tier1 expires in 1 yr time, dont want to affect her visa coz of my hsmp expiration.
2) Fund maintenance for 90 days required for tier1 dependant. but tier4 required only 28 days.

You cannot, because the question asks for a fact(s).

Do not lie (or withhold information) as doing so may have serious consequences.

actually am not going to lie or withhold any information.
My question is as we are going to mention evrything truth in the application.
Just want to know will there be any issues if we do the tier4 visa, if husband is still in UK?
Chances are there to get doubt on the applicant. to avoid this, do we need to mention anything in the covering letter? if yes what to mention in it.
Reason we are going to give "Does not want to affect her studies coz of status of my Tier1 visa".

Since my visa expires in 2011 Jan, even her student visa is for 1 year, if at all she could not complete within this time, she can extend and continue if she is in Tier4, but this cannot be done is Tier1 dependant.

I hope am clear on my questions. Please help us to proceed further on this.

There is no law that states that spouse of Tier 1 (General) migrant cannot apply for EC as Tier 4 migrant.

If you wish to mention something in the cover letter, explain the real reason(s):
Since my visa expires in 2011 Jan, even her student visa is for 1 year, if at all she could not complete within this time, she can extend and continue if she is in Tier4, but this cannot be done is Tier1 dependant.
My HSMP Tier1 expires in 1 yr time, dont want to affect her visa coz of my hsmp expiration.
