Unmarried partner of right of Abode

Post by vicky80 » Wed Oct 27, 2010 11:26 pm

I have a slightly unusual situation I need some advice on. I am currently in the UK on an EEA family member visa through my ex partner. We lived together for a year before separating and are planning to divorce this year (3.5 years later, all in the UK). I understand I am able to apply to retain my right of residence under section 10 of the Immigration (European Economic Area) Regulations 2006 however getting all of the documentation together is proving difficult as I did not save a lot of paper work and my ex partner is less than helpful. The thing is I am currently in a long term relationship my current partner who has a ex-commenwealth right of abode visa. We will have been together for 2 years in February. My question is can I apply for a visa through my current partner? What would I need to prove?
